Account setup
Our accounts are provisioned automatically, however, we and/or our payment partners will manually screen your account over the subsequent 72 hours for potential fraud. If there is ever an issue or we need to contact you, it will be through the primary email address on file so ensure it is not under the domain(s) associated with the product.
Migration
Our transfers team will do their utmost to assist you in transferring your website to our platform, however, we cannot provide a guarantee for the success of the process. We offer this service out of goodwill and cannot promise its availability or the amount of time it may take as each hosting environment is configured differently. We will do our best to help you, but in some cases, it may not be possible to transfer data from a previous host.
Content
All services provided by MOIPA may only be used for lawful purposes. The laws of Europe apply.
The customer agrees to protect MOIPA from any legal claims that may arise from using the services provided. it is forbidden to use the services to breach any copyright or trademark law, including but not limited to illegally copying music, books, photographs or any other copyrighted material. If we find that you are selling any counterfeit goods with a trademark, a warning will be issued and you will be asked to stop the activity immediately. If you believe your copyright or trademark is being infringed, please contact [email protected]. Additional documentation may be necessary if the issue is related to licensing.
Examples of unacceptable material on all servers include: IRC Bots, Pirated Software / Warez hosting, image, filedump, or banner-ad services (similar to rapidshare, photobucket, or commercial banner ad rotation), topsites, commercial audio streaming (more than one or two streams), Escrow, High-Yield Interest Programs(HYIP) or related sites, Investment sites (FOREX, egold exchange), sale of any controlled substance without prior proof of appropriate permit(s), AutoSurf sites, Bank Debentures, Bank Debenture Trading Programs, Prime Banks Programs, lottery sites, muds / rpg’s, hate sites, hacker focused sites/archives/programs, or sites promoting illegal activities, IP Scanners, Brute Force Programs, Mail Bombers and Spam Scripts.
We maintain the authority to deny service to anyone. Any content that we deem as obscene or threatening is not allowed and will be removed from our servers with or without notification. Not replying to our abuse department’s correspondence within 48 hours may result in the interruption or termination of your services. All issues of abuse must be addressed through email and will receive a reply within 48 hours. We strictly forbid any activity that may harm minors, such as child pornography or content that could be interpreted as such. We will immediately suspend any website found to be hosting or linking to this type of material, and depending on the circumstances may terminate it. We will closely monitor any further violations of this rule, and in case of multiple infractions, we will immediately terminate your account.
Violations of a significant nature will be reported to the appropriate law enforcement agency.
Zero tolerance spam policy
We have a strict policy against sending any kind of unwanted emails, bulk emails, and spam. We will not accept any emails sent through “safe lists” and “double opt-in”. Any account that is found to be sending out spam will be terminated immediately without warning.
Sites that have been sent out via spam (spamvertised) are not allowed to be hosted on our servers. This includes, but is not limited to, spam sent via fax, email, instant messaging, or usenet/newsgroups. any organization or entity which is listed in the ROKSO may not be hosted on our servers. Any account which results in our IP space being put on a blacklist will be suspended or terminated instantly. MOIPA reserves the right to require changes or disable any website, account, database, or other component which does not follow its policies, and can make any such changes in an emergency if necessary.
MOIPA reserves the right to charge the holder of the account used to send any unsolicited e-mail a clean up fee. The cost of the clean up fee is entirely at the discretion of MOIPA.
Payment information
You consent to paying in advance for the services you receive from MOIPA. unless you inform MOIPA that you want to cancel any or all of the services you get, you agree that they will be charged on a regular basis.
As a MOIPA customer, it is your obligation to make sure your payment information is current, and all invoices are paid on schedule. MOIPA offers a 10 day grace period from when the invoice is due and when it must be paid. Any invoice that is overdue for 10 days and not paid will incur a £7 late fee and/or an account suspension until the account balance has been paid in full.
MOIPA reserves the right to change the monthly payment amount and any other charges at anytime.
Cancellations and refunds
MOIPA reserves the right to cancel the account at any time with or without notice.
Any abuse of our staff in any medium or format will result in the suspension or termination of your services.
You can cancel your subscription at any time by submitting a cancellation request through the client control panel at least 7 days before the renewal date. Cancellations cannot be made through support tickets or emails. MOIPA offers a 7 day money back guarantee on shared hosting. Domain name purchases and any form of licensing fees are non-refundable. MOIPA reserves the right to refuse any refund requests. Refunds will only be provided if the problem is caused by MOIPA or is a result of their fault. Refund requests from customers whose product/service is working properly or is not working due to the customer’s fault will be declined.
Violations of the Terms of Service will waive the refund policy.
Price change
You won’t ever be charged more for your hosting after you’ve made the purchase. We have the right to alter the prices listed on MOIPA.uk and to give plans more resources at any point.
Indemnification
Customer agrees that it shall defend, indemnify, save and hold MOIPA harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney’s fees asserted against MOIPA, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless MOIPA against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with MOIPA; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customers from MOIPA’s servers.
Arbitration
If you decide to use any of MOIPA’s services, you are agreeing to be bound by arbitration. If there are any disputes or claims involving MOIPA or its subsidiaries, they will be dealt with by an arbitrator selected by MOIPA. the arbitrator’s ruling will be binding and final. You will also be responsible for paying all costs associated with arbitration.
Disclaimer
MOIPA shall not be responsible for any damages your business may suffer. MOIPA makes no warranties of any kind, expressed or implied for services we provide. MOIPA disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by MOIPA and its employees.
Law enforcement
MOIPA may provide any of its subscribers’ information to law enforcement agencies upon request. We will be fully cooperative with law enforcement if they present us with a legally binding request.
Changes to these terms & conditions
